Recent media reports and a White House press conference brought attention to ongoing efforts by the Obama Administration to expand gun control through executive orders and regulatory changes bypassing Congressional approval. This agenda includes a proposal to change the rules concerning use of trusts for firearms regulated by the National Firearms Act (“NFA”). This proposal has not received final approval. If that approval is given, an effective date for any new rules must be announced with enough advance notice to provide regulators and the regulated enough time to come into compliance. Thus far, the proposed rule changes would seem to allow continued use of trusts for NFA firearms particularly for two very important benefits: to allow possession of NFA firearms by others and to create an estate plan for the inheritance of a gun collection outside the court system.

For those who believe future gun controls will make gun ownership more difficult, then they should consider acting now to get their affairs in order before any new gun controls take effect. The Arsenal Gun Trust: Act Now

In light of recent proposals by the Obama administration to initiate new gun controls on NFA firearms, we believe now is the time to act.  If you do not already have an Arsenal Gun Trust, now is the time to contact us to create one and to use it immediately.  If you are one of our existing clients, use your Arsenal Gun Trust immediately to submit applications to BATFE for NFA firearms.  

The reported executive order concerning NFA firearms is still in the proposal stage.  We will shortly recommend ways to exercise your rights to influence the rule-making process. We will probably not see any final decisions, if any, and an effective date for new regulations until months from now. 

Nevertheless, act now to have the best chance to avoid future restrictions that could make your applications to BATFE more difficult at a later date. 

Tommorrow the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) will formally announce proposals concerning trusts in the registration of firearms regulated by the National Firearms Act (NFA). The public will have a 90 day period ending December 9, 2013 to comment on these proposals.  A link to BATFE's announcement in the Federal Register can be found here.

The proposed changes will allow the continued use of trusts for the registration of firearms; however BATFE wishes to require so-called 'responsible persons' of a trust to be subject to the same requirements as non-trust applicants, i.e. fingerprinting, photographs, and a sign off by the the local Chief Law Enforcement Officer (CLEO).

While this proposal would create additional red-tape, the proposed rules would preserve the important benefit of using a trust to allow lawful possession of NFA firearms by appropriately identified and documented individuals. For our clients, this aspect of the Arsenal Gun Trust is crucial in their effort to comply with the law and to keep their firearms safe.  For example, a husband could identify his wife as a 'responsible person' in his trust and therefore provide her the combination to his gun safe without concern of committing an unlawful transfer of the NFA firearms contained inside. Similarly, a soldier could use his Arsenal Gun Trust to ensure no law is broken if his father helps store his firearms during a deployment overseas.

Additionally the Arsenal Gun Trust will continue to be the estate plan of choice for gun owners. Our trust helps clients and their loved ones safely, lawfully, and privately inherit entire gun collections--without a court proceeding or public court record.

Because of the possiblity BATFE could adopt the proposed rules next year or later, we recommend anyone interested in NFA firearms create a trust now and register NFA firerarms now before any changes to the rules might occur.

Today the National Rifle Association (NRA) criticized what it said was a 'flawed' proposal by the Obama Administration to create additional red tape for the transfer and manufacture of firearms regulated under the National Firearms Act (NFA), including silencers, short barrel rifles and shotguns, and the vintage machine guns permitted for civilian ownership.

No one can guess if/when/or how this proposal would ultimately change NFA regulations. It is subject to a public process during which the design of the proposal could change. Further, a final order to change the regulations must provide enough advance notice to allow the public to act and prepare before it takes effect.

The bottom line? In this climate, and for the foreseeable future, one can only assume firearms ownership, including the NFA category, will only become more difficult.
